1.
SWEEPSTAKES PERIOD: Mum's
Original Giveaway Sweepstakes (the “Sweepstakes”) begins on or about August 4,
2012 and runs through the month of August 2012. On each Friday during the month
of August 2012, Sponsor will offer a chance to win one of five Mum's Original
products beginning 9am EST of each Friday and ending 6pm EST at the end of each
Friday (each Friday is a “Sweepstakes
Period”). All entries must be received no later than 5:59 p.m. ET on each Friday, after which time that Friday's Sweepstakes will be closed and no further
entries shall be accepted. MO's server/clock is the official time keeping
device for the Sweepstakes.
2. SWEEPSTAKES ELIGIBILITY/PARTICIPATION: The
Sweepstakes is open in the fifty (50)
United States, D.C. and all provinces of Canada, excluding the Province of
Quebec and Puerto Rico (“North America”) and is offered only to legal
residents who have reached the legal age of majority in their state or province
of legal residence at time of entry. Employees, directors and officers and
their immediate family members (spouses and siblings, parents and children and
their spouses) and household members (whether or not related) of MO and any of
their parents, subsidiaries, affiliates, assigns, advertising and Sweepstakes
agencies, and any individuals or companies involved in the administration,
implementation or execution of the Sweepstakes are not eligible.
By entering this Sweepstakes (an "Entry"), either by liking
Mum's Original on facebook or by retweeting
the contest notification on twitter, you
agree to: be bound by these Official Rules and the decisions of MO which are final
and binding in all respects; release and indemnify MO and its parent(s),
subsidiaries, affiliates and/or related companies and each of their officers,
directors, shareholders, employees, advisors, assignees, agents, licensees,
representatives, advertising, media buying and promotional agencies from any
threatened or actual claims, actions, damages, and liabilities in connection
with the Sweepstakes and/or the Grand Prize, and the use of their Entry and
name, likeness and image.
All parties who have liked us on Facebook that Friday or on prior dates
are eligible. Only those who retweet the contest notification via Twitter on
that particular Friday are eligible for that Sweepstake Period prize.
Once submitted, an Entry cannot be modified by the submitting entrant,
nor deleted or cancelled. Entrants may not enter through a
promotion/sweepstakes club (or similar method), with multiple e-mail and/or
street addresses, nor shall entrants use any other device or artifice to enter
the Sweepstakes more than the permitted number of times. Any entrant who uses
fraudulent entry methods, or otherwise attempts to participate with multiple
e-mail and/or addresses under multiple identities will be disqualified. In case
of dispute, on-line entries will be declared made by the authorized account
holder of the e-mail address submitted at the time of entry. “Authorized
account holder” is defined as the natural person who is assigned to an e-mail
address by an Internet access provider, online service provider, or other
organization (e.g., business, educational institution, etc.) that is
responsible for assigning e-mail addresses for the domain associated with the
submitted e-mail address. MO reserves the right, at its reasonable discretion
to refuse, disqualify, or withdraw any Entry and/or entrants at any time during
the Sweepstakes Period.
Only one (1) eligible Entry will be accepted per person during each of
the Sweepstakes Period. Proof that an entrant submitted an Entry does not
constitute proof or evidence that it was received within the Sweepstakes
Period.
PRIZE: one of five grand prizes
(each, a “Grand Prize”) are available to be won during the Sweepstakes Period,
consisting of a bag of Mum's Original products as identified in the contest
notification set out on Facebook and on twitter at the beginning of each
Sweepstakes Period. The approximate retail value of the Grand Prize shall vary
each week but will be between $6-$10CDN .
If the Grand Prize (or any component thereof) is not awarded to an
initial Grand Prize winner or is forfeited, an alternate Grand Prize winner may
be selected in MO's discretion. Grand Prize awards are subject to
verification of eligibility and compliance with the Official Rules. In no event
will more than five Grand Prizes be awarded during the Sweepstakes Period.
4. GRAND PRIZE SELECTION: MO's
random drawings for the Grand Prize winners will be held from all eligible
Entries received, in Toronto, Ontario on each Friday of the Contest at 6pm EST.
Each entry qualifies for a chance to win the grand prize for each drawing date.
The random drawing will be carried out by MO. The odds of winning the
Grand Prize depend on the number of eligible Entries received.
Each potential Grand Prize winner will be notified on or within four (4)
days of the applicable drawing either by: (i) an initial telephone call during
regular business hours (ET) at the contact telephone number provided at the
time of entry; or (ii) an e-mail at the e-mail address provided at the time of
entry. If a selected entrant cannot be reached within 48 hours from the time of
initial contact, an alternate Grand Prize winner may be selected until such
time as a selected entrant satisfies the terms of this section.
Once contacted, a potential Grand Prize winner must, in order to be
declared eligible to receive a Grand Prize:
(i) comply with these Official Rules;
(ii) if the Grand Prize winner is from Canada, they
must correctly answer a time-limited mathematical skill testing question (which
will be administered at a pre-arranged time with the selected entrant) without
the assistance of another person or mechanical device; and
5. WINNER’S LIST: For the Grand Prize winners’ names,

6. CONSENT TO USE PERSONAL INFORMATION: By
entering the Sweepstakes and voluntarily providing your personal information
(including, but not limited to, e-mail address, first name, last name, age,
address, postal code or ZIP, television services provider, and phone number
(collectively “Registrant Information”)) you consent to MO's collection and use
of your Registrant Information to administer this Sweepstakes ONLY. , Mo shall
not use your Registrant Information to contact you for any other purpose. All information provided by entrants shall be
used in accordance with MO's privacy policy available at http://www.mumsoriginal.com/about/privacy-policy.aspx.
7. GENERAL RULES:
a) MO shall not be responsible for or bear any
liability for: (i) late-received, lost, unintelligible/illegible, incomplete,
or misdirected Entries; (ii) entrants or Entries which fail to comply with
these Official Rules; and (iii) any technical malfunction of any computer
on-line systems, servers, access providers, computer equipment, software,
failure of any e-mail or entry to be received on account of technical problems
or traffic congestion on the Internet or at any website, or any combination
thereof including any injury or damage to an entrant's or any other person's
computer related to or resulting from downloading any material in the
Sweepstakes, all of which may affect an entrant’s ability to participate in the
Sweepstakes.
b) MO reserves the right to cancel or suspend any
portion of this Sweepstakes should a virus, bug or other cause beyond the
reasonable control of the MO corrupt the security or proper administration of
the Sweepstakes. Any attempt to deliberately damage any website or to undermine
the legitimate operation of this Sweepstakes is a violation of criminal and
civil laws, and should such an attempt be made, MO reserves the right to seek
remedies and damages to the fullest extent permitted by law, including criminal
prosecution.
c) By participating in this Sweepstakes and/or the
Grand Prize, each Grand Prize winner agrees that his/her name, image,
photographs, voice, biographical information and/or other indicia of persona
may be used by MO in any and all forms of media, including but not limited to
the World Wide Web and internet, without any further compensation or review and
waives all rights (including moral rights) with respect to printed, broadcast
and other forms of publicity. Written confirmation of the foregoing in the form
of the Consent referred to above must be executed by each Grand Prize winner
and provided to MO.
d) Each entrant agrees that MO and their affiliates,
officers, directors, shareholders, agents, representatives and employees and
all others associated with the development and execution of the Sweepstakes
(“Released Parties”) shall have no liability and shall be held harmless in
respect of any and all manner of action, causes of action, suits, debts,
covenants, contracts, claims, and demands, including legal fees and expenses,
whatsoever, arising now or in the future, including but not limited to, claims
based on negligence, breach of contract and liability for any physical injury,
bodily injury, death, disability, or property damage or any other loss which
the entrant or his or her administrators, heirs, successors or assigns might
have or could have, by reason or arising out of the entrant’s participation in
the Sweepstakes, and/or in connection with the acceptance, possession, use or
misuse, of the Grand Prize, whether or not caused in whole or in part by the
negligence of one or more of the Released Parties.
e) All Entries are subject to verification by MO and MO
also reserves the rights to cancel and revoke any Entries if they are found to
be improper or if the entrant is subsequently found not to be eligible pursuant
to these Official Rules.
f) In the event of unavailability of the stated Grand
Prize (or any portion thereof), MO, in their sole discretion, reserves the
right to substitute a prize of equal or greater value.
g) The Grand Prize is not transferable, not
refundable, and not redeemable for cash in whole or in part, will not be
extended under any circumstances and must be accepted as offered. Any unused
portions of the Grand Prize will be forfeited and will have no cash value.
h) By participating in this Sweepstakes, entrants
agree to be bound by these Official Rules and the decisions of MO, which
decisions shall be final and binding upon all entrants. Failure to comply with
these Official Rules may void an entrant’s rights vis a vis the awarding of the
Grand Prize. Interpretation of these Official Rules by MO shall be final. If
applicable, shipped prizes shall not be insured and MO shall not assume any
liability for lost, damaged, or misdirected prizes.
i) MO may terminate, modify or suspend this
Sweepstakes at anytime and may amend the Official Rules or administration of
this Sweepstakes without notice in their sole discretion in any commercially
reasonable manner.
j) MO shall not be liable to winners or any other
person for failure to execute the Sweepstakes, or supply a prize or any part
thereof, by reason of any act of God, any action(s), regulation(s) order(s) or
request(s) by any governmental or quasi-governmental entity (whether or not the
action(s), regulation(s), order(s) or request(s) prove(s) to be invalid),
public health crisis, equipment failure, terrorist acts, earthquake, war, fire,
flood, explosion, unusually severe weather, hurricane, embargo, labor dispute
or strike (whether legal or illegal), labor or material shortage,
transportation interruption of any kind, work slow-down, civil disturbance,
insurrection, riot, or any similar or dissimilar event beyond its reasonable
control.

OFFICIAL PRIVACY POLICY
INTRODUCTION
Mum's Original Inc.
and its affiliates (collectively, "MO") respects the privacy of all
of its users and customers and is committed to protecting such privacy in
accordance with this Privacy Policy. This policy explains how MO will treat
your personal and non-personal information collected in connection with your
activities on or related to all MO websites referencing this policy (the "MO
Sites"). Your access or use of any MO Site indicates your understanding
of, and agreement to be bound by, this policy and the MO website Terms and
Conditions. If you do not agree to this Privacy Policy please do not use a MO

Please note that at
its discretion, MO reserves the right to change, modify, add, or remove
portions of this Privacy Policy. Changes will become effective when posted on a
MO Site with no other notice provided. Please check this Privacy Policy
regularly for updates. Your continued use of a MO Site following the posting of
changes to this Privacy Policy constitutes your acceptance of those changes.
WHAT TYPE OF INFORMATION IS COLLECTED
In the course of
operating the MO Sites, MO may collect both Non-Personal Information and
Personal Information about its users.
"Non-Personal
Information" is information of an anonymous nature, including but not
limited to your Internet Protocol Address ("IP Address"), the type
and version of browser or operating system you may be using, and the website
you may have come from and visit next. Aggregate information compiled by MO,
such as demographic statistics of our users (e.g. average age or geographical
allocation of our users), number of visitors, average time spent on a MO Site
and ads clicked through, is also considered Non-Personal Information. Business
contact information such as the name, title, business address, email address or
telephone number of a business or professional person or an employee of an
organization is also Non-Personal Information.
Non-Personal
Information is collected or derived by us in the course of operating the MO
Sites. For example, our web servers may automatically collect Non-Personal
Information which is provided through your browser or stored on a Cookie or
through a Web Beacon when you choose to visit a MO Site. Non-Personal
Information is used by MO as described below.
During normal website
usage, it is possible to use MO Sites without communicating any personal
information. However, to make use of certain features on our sites, such as
promotions, sweepstakes and contests, quizzes, personalized services,
subscriptions or newsletters, users may be asked to register with the MO Sites.
As part of this voluntary registration, MO may request contact information and
other data required for operating these services.
"Personal
Information" is personally identifiable information, such as your name,
address, email address, birth date and gender. MO can only collect Personal
Information from you if you voluntarily provide it. By sending us a comment or
suggestion, by entering any available chatroom or bulletin board, or by
entering a sweepstakes, contest or promotion that is posted on a MO Site, you
will be consenting to the collection, use and distribution of your Personal
Information by MO for the purposes set out below (unless if specifically
excluded in the Contest Rules). You are under no obligation to provide MO with
Personal Information and can access and enjoy many parts of the MO Sites
without providing any Personal Information. Among other things, the following
is a representative list of reasons MO may ask for your Personal Information:
- To administer sweepstakes, contest or promotions, select entrants, and choose prize winners;
- To determine whether MO's television and other services are available to you in your area;
- To respond to your questions or the comments you e-mail to us or when you contact any of our customer service representatives;
- To provide you with newsletters or other information about our programming, special offers or services;
- To distribute to sponsors and advertisers who run sweepstakes, contest or promotion and/or for purposes of marketing by our sponsors and advertisers; and
- To keep aggregate information on website use.
MO may receive
Personal Information from its business partners and other third parties,
provided that such third parties confirm to us that they have obtained your
consent to the disclosure of your Personal Information. MO will not use this
information except for the purposes that you have consented to with MO's
business partners or other third parties who collected the information. MO can
rely on the representations of its business partners and other third parties
that the proper consents were obtained when the Personal Information was
collected.
HOW YOUR PERSONAL INFORMATION WILL BE USED BY
MO
MO will only use
Personal Information for the purposes stated at the time of collection and
pursuant to applicable privacy laws, or as otherwise set out in this section:
a. Providing you with
the services and information you have requested from us, including your use of
the MO Sites. MO may from time to time use your Personal Information to contact
you about changes, enhancements or similar notices related to the MO Sites;
b. If you indicated that
you were interested in receiving offers or information from MO or certain of
our selected business partners, sponsors or advertisers, MO may send you email
materials and other mailings about products and services that MO feels may be
of interest to you. If at any time you would like to end your subscription to
any such email materials, follow the directions for unsubscribing posted at the
bottom of the email material;
c. If you enter a
sweepstakes, contest or other promotion offered on an MO Site, MO may, under
the rules of the promotion, use your name and certain other information to
administer the promotion, such as contacting, announcing and promoting the
winners of the promotion;
d. MO may also use
Personal Information if it has reasonable grounds to believe the information
could be useful when investigating a contravention of a federal, provincial or
foreign law or in order to protect or defend a legal interest; and
e. MO may ask for your
permission to use your Personal Information for other purposes, for example, to
send you an email newsletter, to contact your television services provider on
your behalf concerning your interest in subscribing to MO's television network,
or for other marketing purposes. MO will only use this information for these
purposes if you have provided us with consent either on a ballot that was
previously filled out or by "opting-in" to such offers on any MO
online forms. If we attempt to contact you and you do not respond, by default, MO
will assume that your consent has been retracted and shall delete your Personal
Information from MO's system.
With Whom Your Personal Information May Be
Shared
Your Personal
Information will not be sold or rented to anyone.
MO WILL ONLY DISCLOSE
YOUR PERSONAL INFORMATION TO THIRD PARTIES:
a. Where you have
specifically given us your consent to disclose your Personal Information for a
designated purpose;
b. Who are acting on our
behalf as our agents, suppliers or service providers, solely to enable us to
more efficiently provide you with the requested services. MO will only provide
Personal Information as is necessary in the circumstances will be provided.
Such entities act under strict contractual controls, requiring them to maintain
the confidentiality of all such Personal Information and to use such Personal
Information solely for purposes related to the provision of the services;
c. As may be set out in
the Terms and Conditions applicable to a MO Site, to facilitate the provision
of such service, such as fulfilling legal requirements;
d. As required by law,
including by an order of any court, institution or body with jurisdiction or
authority to compel the production of information, or in order to protect or
defend a legal interest; or
e. In connection with a MO
corporate re-organization, merger or amalgamation with another entity, or a
sale of all or a substantial portion of the assets of MO provided that the
Personal Information disclosed continues to be used for the purposes permitted
by this Privacy Policy by the entity acquiring the Personal Information.
While MO tries to
ensure its third party partners share our high standards and respect for
privacy, please understand that MO is not responsible for the content of, or
the privacy practices employed by, other companies or websites.
Opting-Out of Certain Uses of your Personal
Information
You may
"opt-out" of MO's collection, use and disclosure of your Personal
Information.
HOW NON-PERSONAL INFORMATION WILL BE USED BY
MO
Non-Personal Information
is used generally by MO to monitor and improve the operation of the MO Sites,
to perform statistical analyses of the collective characteristics and behavior
of our users, to measure user demographics and interests regarding specific MO
services, to describe our services to third parties such as prospective
business partners and advertisers and to analyze how and where best to use our
resources. No Personal Information will be disclosed during these activities.
MO also may share
this information with our affiliates, suppliers, sponsors and advertisers. MO
may use Non-Personal Information to inform our sponsors and advertisers as to
the performance of a particular sponsorship (such as a contest) or
advertisement or to inform our affiliates about subscriber interest in MO's
services in a particular region or area. In such case MO may disclose to those
third-party affiliates, sponsors and advertisers the overall aggregate
demographics available regarding, for example who expressed interest in MO's
services, participated in a contest or saw and "clicked" on an
advertisement. No Personal Information will be disclosed to these affiliates,
sponsors and advertisers as part of this process; only information in an
anonymous, aggregate form will be disclosed.
WHAT COOKIES ARE AND HOW THEY ARE USED
"Cookies"
are simple text files that web browsers place on computer hard drives when
sites are visited. Cookies cannot damage files, nor can they read information
from a user's hard drive. The Cookie, by itself, doesn't tell us your email
address or who you are. When you participate in our activities, MO does not
store any Personal Information within Cookies, nor does MO link or combine
information collected through Cookies to any Personal Information submitted
online. MO uses Cookies to help us measure the number of visits, average time
spent, page views, and other statistics relating to use of our sites. As a
convenience for users, MO also uses Cookies to remember non-personally
identifiable user-names so that the need for multiple log-ins is eliminated.
MO allows third-party
companies to serve ads and/or collect certain anonymous information when you
visit the MO Sites. These companies may use non-personally identifiable
information (e.g., click stream information, browser type, time and date,
subject of advertisements clicked or scrolled over) during your visits to this
and other MO Sites in order to provide advertisements about goods and services
likely to be of greater interest to you. These companies typically use a cookie
or third party web beacon to collect this information. To learn more about this
behavioral advertising practice or to opt-out of this type of advertising, you

Please note certain
features on our sites may not function if you do not accept Cookies.
IP ADDRESS
An IP Address is the
unique number which is assigned to every direct Internet access point. IP
Addresses do not contain any Personal Information. When you, through your
browser, request a web page or similar Internet information from another
computer on the Internet, your browser automatically provides that computer
with an IP address to which it will send the requested information.
Whenever you request
a MO web page or certain other similar MO content, your browser automatically
provides our computers with your IP Address, to which our computers will send
the requested information. Each such request is logged by our computers with
information including the IP Address of the computer that requested the page
and is stored by our computers as needed for the purposes described in this
policy.
MO may use your IP
Address to display more appropriate and relevant content and advertising, such
as content and advertising based on your geographic area. Aggregate information
derived from IP Addresses may be reported by MO to its affiliates, advertisers
and partners. For example, MO may report to its advertisers the estimated total
number of users accessing a particular MO Site from a specific state.
MO may use your IP
Address to facilitate the diagnoses and remedy of a technical problem reported
by you or our technical team.
WEB BEACONS
Certain MO Services
may contain electronic images known as Web Beacons - sometimes called
single-pixel gifs - that allow MO to count users who have visited those pages
and to deliver co-branded services. Web Beacons are not used to access your
Personal Information. They are a technique used to compile aggregated statistics
about MO Site usage. Web Beacons collect only a limited set of information
including a Cookie number, time and date of a page view, and a description of
the page on which the Web beacon resides. Certain MO Sites may also contain Web
Beacons placed there by our advertising partners to help MO determine the
effectiveness of our Internet advertising campaigns.
HOW YOU CAN UPDATE, ACCESS OR DELETE YOUR
PERSONAL INFORMATION
At any time, you may
remove your Personal Information from our database by emailing us at with
your username and "remove me" in the subject line.
LINKS TO OTHER SITES AND ADVERTISEMENT
A MO Site may contain
links to other websites and services. While MO tries to link only to sites and
services that share our high standards and respect for privacy, please
understand that MO is not responsible for the content of, or the privacy
practices employed by, other companies or websites. This policy applies only to
the MO Sites referencing this policy.
SECURITY
MO is committed to
protecting your privacy. Security measures, such as locked cabinets, restricted
access and the use of passwords and encryption have been adopted to protect
your Personal Information against loss or theft, as well as unauthorized
access, disclosure, copying, use or modification. Our employees have been
trained to respect your privacy at all times and those employees with access to
your Personal Information shall use your Personal Information strictly in
accordance with the MO Privacy Policy and the laws applicable to each specific
business.
ACCURACY
MO will try to ensure
that information about you is accurate, complete and up-to-date. However,
please inform MO to whom you provided your information of any change of name,
address or other information. In the event you have questions about the
accuracy of factual information MO has collected about you, you will have
access to that information in order to verify and update it. If MO has
disclosed inaccurate information about you to a third party, MO will be pleased
to contact the third party in order to correct the information.
WHAT IF I DON'T AGREE WITH YOUR PRIVACY POLICY
By visiting our MO
Sites and voluntarily providing Personal Information to the MO Sites, you agree
to the terms of this online Privacy Policy contained herein. If you do not
agree to these terms, or wish to limit the use of any of your Personal
